AGREEMENT BETWEEN YOU AND MEGADROPSHIPPERS.COM
The Megadropshippers.com Web Site is operated by Megadropshippers.com, 1100 North Magnolia Ave. #J, El Cajon, CA 92020. These Terms of Service apply to Megadropshippers.com and not to the content of third parties. PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE. All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site.
Acceptance of Terms of Use. These Terms and other applicable conditions and notices contained herein govern your use of the Megadropshippers.com service and Web site. By using, visiting, or browsing the Megadropshippers.com site(s), you accept and agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, you should not use the Megadropshippers.com or Web site. Please note, return shipments sent to the address above will be refused. Please contact our customer support team at sales@megadropshippers.com for instructions before returning products.
These Terms of Use are an ongoing contract between you and Megadropshippers.com and apply to your use of the Megadropshippers.com service and Web site. These Terms of Use affect your rights and you should read them carefully.
Changes to Terms of Use. Megadropshippers.com reserves the right, from time to time, with or without notice to you, to change these Terms of Use in our sole and absolute discretion. The most current version of these Terms of Use can be reviewed by clicking on the links that direct you to the Terms on the Megadropshippers.com Web site. The most current version of the Terms will supersede all previous versions. Your use of the Megadropshippers.com Web site or continued use of our service after changes are made means that you agree to be bound by such changes.
Prices. We reserve the right to change prices at any time. Due to possible information misrepresentations, we may correct typographical and printing errors related to prices at any time.
Dropship Membership Fee. Your dropship membership fee will be fully refunded to you after you have surpassed $1000.00 in purchases from Megadropshippers.com. Please contact us at sales@megadropshippers.com once you have completed $1000.00 in sales.

These communications are part of your relationship with Megadropshippers.com and you are entitled to receive them as part of the Megadropshippers.com community. You agree that any notice, agreements, disclosure or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.
Service Testing. From time to time, we test various aspects of our service, and we reserve the right to include you in these tests without notice.
Use of Information Submitted. Megadropshippers.com is free to use any comments, information, ideas, concepts, reviews, or techniques contained in any communication you may send to Megadropshippers.com, including, without limitation, responses to questionnaires or through postings to the Megadropshippers.com Web site without further compensation, acknowledgement or payment to you for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products and creating, modifying or improving the Megadropshippers.com Web site or other Web sites. Furthermore, by posting any information on our site, submitting suggestions, or in responding to questionnaires, you grant us a nonexclusive, royalty-free license to display, use, reproduce or modify that information.
Account Access; Identity Protection. In order to provide you with ease of access to your account, Megadropshippers.com will place a cookie (a small text file) on any computer from which you access the Megadropshippers.com Web site. When you revisit the Megadropshippers.com web site, this cookie will enable us to recognize you as a previous user or as the account holder and provide you with direct access to your account without requiring you to retype any password or other user identification. You are responsible for updating and maintaining the truth and accuracy of the information you provide to us relating to your account.
You are also responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You may not share your account with other people by providing them your password. However, if you decide to share your account with other people, you take full responsibility for their actions and liabilities. Users of public or shared computers should log out at the completion of each visit to the Megadropshippers.com Web site.
If you find that you're a victim of identity theft and it involves a Megadropshippers.com account, you should notify customer service. Then, you should report this instance to all your credit card issuers, as well as your local law enforcement agency. Megadropshippers.com reserves the right to place any account on hold anytime with or without notification to the subscriber in order to protect itself and its partners from what it believes to be fraudulent activity. Megadropshippers.com is not obligated to credit or discount a membership for holds placed on the account by either a representative of Megadropshippers.com or by the automated processes of Megadropshippers.com.
Products. Megadropshippers.com diligently strives to provide as accurate information as possible. However, as distributors and manufacturers provide a large portion of this information, Megadropshippers.com makes no warranty expressed or implied with respect to accuracy of the information, including price, product descriptions or product specifications. Both the product and manufacturer names are used only for the purpose of identification. Members are responsible for making sure the product information is correct prior to selling any products from this site with the product's respective Manufacturers.
Shipping and Handling. Megadropshippers.com and its distributors/suppliers reserve the right to restrict shipments to within the Continental U.S., Alaska, Hawaii. and other prelisted countries shown in our shopping cart checkout. Orders with APO, or FPO shipping addresses will not be processed.
Shipping and Handling Charges. You are responsible to pay the shipping and handling charges for all products purchased from Megadropshippers.com You are responsible for these charges for shipments that are refused or returned for any reason. We are not responsible for incidental or consequential damages or losses to defective products, errors in shipping your order, or other errors. The limit of our liability is the replacement cost of any item you purchase from us. ANY ODD SIZED OR EXCESSIVE WEIGHTED ITEMS WILL REQUIRE A CUSTOM SHIPPING COST CALCULATION FROM Megadropshippers.com. THESE ORDERS WILL NOT SHIP UNTIL YOU HAVE APPROVED THE CUSTOM SHIPPING COST. Megadropshippers.com may not publish, via the web site, E-mail, traditional mail, phone, or fax, the shipping weights of items listed in our warehouses because our suppliers may not provide it for us. Members should use the shipping figures based on the shipping rate charged to you by Megadropshippers.com's shipping.
Order Changes. Orders cannot be edited after they have been placed. They can only be cancelled. The member must then resubmit their order. Order cancellations are done by Megadropshippers staff only. Order cancellations must be made by phone or email only. We do not take order cancellations via the live chat. Our shipping cut off time for the day is at 12PM PST Monday thru Friday. We do not ship out on the weekends. All orders placed before 12PM PST will ship out the same business day. All orders placed after 12PM PST will be shipped out the following business day. If you place an order before 12PM PST and would like to cancel it, we must receive the cancellation notification on the same day before 12PM PST. If we receive the order cancellation after 12PM PST for and order that was placed before 12PM PST, then the order will ship out. If you place an order after 12PM PST and would like to cancel it, you have until 12PM PST the next business day to send us a cancellation notice. Otherwise the order will ship out.
Taxes. As a client of Megadropshippers.com, you understand that you are absolutely independent entity from Megadropshippers.com. You are responsible to pay taxes to state, federal or local authorities in accordance with any and all applicable laws. This tax responsibility includes collecting and remitting all appropriate sales taxes to state and local authorities.
Relationship between Megadropshippers.com and the reseller (you). Resellers are independent contractors of Megadropshippers.com and are not considered employees of Megadropshippers.com. Resellers are prohibited from making any unauthorized claims by the manufacturer, or claims that are illegal in any state. Resellers do not have the right to bind Megadropshippers.com in any contract related to the business of the reseller. Reseller affirms that reseller is of legal adult age in the state in which reseller resides.
Age. The visitor/member, by signing the Sign up Form, hereby represents that they are of the legal age of the state in which they reside.
Products Sales & Venue Disclaimer. Although all the suppliers Megadropshippers.com works with are authorized distributors of the products they sell, and Megadropshippers.com is authorized to act as a venue to supply said products, this does indicate that all items are suitable for resale under any particular circumstance or venue. Megadropshippers.com acts only as a venue to provide access to wholesale product distributors.
It is the member’s responsibility to ascertain any particular product’s suitability for sale in any given venue that the customer chooses to sell through, whether this is through a “brick & mortar” store, an online store, online auctions, or any other venue. Members are responsible to discover and comply with any specific manufacturer policies or MAP (minimum advertised price) restrictions.
It is also the member’s responsibility as a businessperson to ascertain the legal implications of selling items that may be prohibited, by law or otherwise, in certain regions or venues.
For anyone who plans to sell items through online auctions, it is recommended that you review the terms and conditions of the online auction, as well as check to be sure any product you hope to sell is not prohibited by the online auction. eBay sellers can review eBay’s list of prohibited and otherwise restricted items at the following pages:
Please note, some items which are prohibited are not necessarily against the law to sell, but are simply items that eBay has decided to prohibit based on their own decision. Megadropshippers.com has no control over what is and isn’t legal in any venue or region and is not responsible for the sale of any product through our services.
Copyrights, Trademarks, Namebrands and Patents
It is not our intent to import any items that infringement on exisiting copyrights, trademarks, namebrands, and patents. If such a rare occurence does happen, we will notify all vendors in the product listing. As per our terms and conditions, we will not be held responsible for any ebay auctions lost or any lawsuits filed for infringement occurences.
Legal Recourse. You and Megadropshippers.com agree that the laws of the State of California and San Diego County shall have exclusive jurisdiction over any dispute or claims, policies, and procedures between you and Megadropshippers.com relating in any wan to the Megadropshippers.com service or Web Site or these Terms. You and Megadropshippers.com expressly and irrevocably consent to personal jurisdiction and venue in these courts. The non-prevailing party shall pay all attorney's fees and court costs.
Limitations on Use. You must be 18 years of age or older to subscribe to the Megadropshippers.com Dropshipping Service. While individuals under the age of 18 may utilize the service, they may do so only with the involvement of a parent or legal guardian. Unless otherwise specified we grant you a limited license to access the Megadropshippers.com Web site. You may not download (other than through page caching necessary for personal use), modify, copy, distribute, transmit, display, perform, reproduce, duplicate, publish, license, create derivative works from, or offer for sale any information contained on, or obtained from, the Megadropshippers.comWeb site without our express written consent. Any unauthorized use of the Megadropshippers.com Web site or its contents will terminate the limited license granted by us.
Confidentiality. Reseller understands that all information provided by Megadropshippers.com is confidential and proprietary to Megadropshippers.com and must be used by reseller according to the terms of this agreement. Reseller agrees to not provide any confidential or proprietary information received from Megadropshippers.com to any business entity that may compete with Megadropshippers.com. Any violation of confidentiality is grounds for immediate termination.
Amendments. Megadropshippers.com reserves the right to make amendments to this agreement at any time. Amendments may be the result of changes in economic, legal, or other factors that affect the business of Megadropshippers.com.
Payment. It is the Member's responsibility to obtain payment or assurance of payment from their individual customers before ordering with Megadropshippers.com. Megadropshippers.com strongly recommends obtaining proper address verification systems (AVS) for credit card purchases and making sure all checks are deposited and cleared before placing the order with Megadropshippers.com. Orders placed with Megadropshippers.com are very difficult to cancel, and are subject to any restocking fees. All payment shall be made via credit card payment or U.S. Verified Pay Pal payment for product orders. $ All membership payment shall be made via major credit cards backed by U.S. banks only. Megadropshippers.com will accept no other payment form than those here listed.
Severability. If one or more of the provisions of the policies and procedures in this user agreement are deemed void by law in a court of competent jurisdiction, the balance of the policies and procedures’ remaining provisions, or any provision in the Megadropshippers.com's manual, shall continue in full force and effect.
Website Information. While www.megadropshippers.com and all of its dependent pages contain far too much information to be quoted in their entirety in these Terms and Conditions, the Member is responsible for reading and understanding all information contained on the Website. Megadropshippers.com is not responsible for any inconvenience, loss of profit, or other complication that the Member, his or her business, or his or her customers may experience as a result of the Member’s failure to read and understand all information on the Website. Furthermore, it is the responsibility of the Member to contact and question Megadropshippers.com's customer service representatives regarding any portion of the Website that they have read but do not understand. The Member, for example, is responsible for all information contained in the following pages of the website as well as all information that is accessible by following links found on the following pages:
Return Policy as of 09/19/07
A.Refused Orders:
1. Refused drop shipments will be credited less oringial shipping and handling charges.
2. A new order is required for reshipment and charges will include shipping and handling charge.
B.Returns:
1. A Return Merchandise Authorization number (RMA#) must be obtained from MegaDropShippers Customer Support and is to be marked on the outside of the shipping box for product returns. This RMA# is valid for 45 days after initial purchase date. This equates to a 45 day moneyback guarantee from Megadropshippers. Returned merchandise must be in our possession within 45 days of initial purchase date for store credit to be issued to your dropship account. We encourage all dropship members to post a 30 day moneyback guarantee on their respective website/ebay auction. As previously mentioned, our moneyback gaurantee is 45 days. We will afford our dropshippers the extra 15 days to have the product returned to us.
2. You must ensure that merchandise is returned to receive proper credit. We highly suggest that you purchase delivery conformation with signature confirmation for all return shipments.
3. Shipping on merchandise being returned to MegaDropShippers is to be prepaid by the sender.
4. Defective merchandise will be credited at original invoice price less shipping and handling charges. Reimbursement for defective merchandise will be given in the form of store credit only. Defective merchandise must be in our posession within 45 days of initial purchase date. Defective merchandise returned after 45 days of initial purchase date will be held at our warehouse for pick up by the dropshipper. The dropshipper can also request a Google Checkout invoice to pay for return shipping of the merchandise to them or their customer.
5. Non-defective merchandise:
a. Unused and unopened non-defective merchandise- This merchandise will be credited at original invoice price less shipping and handling charge. Reimbursement for unused and unopened non-defective merchandise will be given in the form of store credit only. Unused and unopened non-defective merchandise must be returned to us in an unused and unopened state with all original contents intitally shipped to the end customer returned to us in an unused and unopened state. If this is not the case then the non defective merchandise will be classified as opened and used. Unused and unopened non-defective merchandise must be in our posession within 45 days of initial purchase date. Unused and unopened non-defective merchandise returned after 45 days of initial purchase date will be held at our warehouse for pick up by the dropshipper. The dropshipper can also request a Google Checkout invoice to pay for return shipping of the merchandise to them or their customer.
b. Used and opened non-defective merchandise- This merchandise is not eligible for store credit/refund or exchange at anytime. In the event that used and opened non-defective merchandise is returned to us, it will be held at our warehouse for pick up by the dropshipper. The dropshipper can also request a Google Checkout invoice to pay for return shipping of the merchandise to them or their customer. If the dropshipper elects to pay a Google checkout invoice for return shipping of the merchandise to them or their customer, the merchanidse will be shipped and will include only the contents that were initially included in the return to us.
6. All returned merchandise that is eligible for store credit (defective merchandise and unused and unopened non-defective merchandise returned within within 45 days of initial purchase date) must be returned in original manufacturer box, INSIDE an outer shipping box, with enclosed documentation and all parts. No returns or credit requests are accepted after 45 days of initial purchase date. Missing items from returns rather non defective or defective will be dedcuted from the resulting store credit issued to your account. Missing item charges will be deducted at the dropship price that is made available to you. 7. Replacement product must be ordered again as a new order with a new order number and will include shipping and handling charges.
8. Store credit will be issued within 14 business days of receipt of merchandise at MegaDropShippers warehouse.
9. If your respective 45 day moneyback guarantee has expired and you or your customer is still in possession of possibly defective merchandise, we suggest that you contact the respective manufacturer to enforce the manufacturer's warranty (if any). For your information, all FTA receivers come with a 2 year manufacturer warranty for repair/replacement.
10. All return inquiries and RMA request must be sent to sales@megadropshippers.com. We do not accept return inquiries and RMA request via telephone, live chat, or by leaving a message via live chat when live chat is offline.
Carrier Loss, Damage/Pilferage
1. Claims for lost shipment, or damage/pilferage must be reported to MegaDropShippers Customer Support within 10 days of delivery/expected delivery date. If you have filed a claim, the claim number must be given to MegaDropShippers Customer Support when you report the damage/pilferage. Original boxes, enclosed documentation and packing materials should be saved. Carriers may require on-site inspection before the product can be returned.
Carrier Loss, Damage/Pilferage
1. Claims for lost shipment, or damage/pilferage must be reported to MegaDropShippers Customer Support within 10 days of delivery/expected delivery date. If you have filed a claim, the claim number must be given to MegaDropShippers Customer Support when you report the damage/pilferage. Original boxes, enclosed documentation and packing materials should be saved. Carriers may require on-site inspection before the product can be returned.
Mis-shipments, mis-billings, and shortages:
1. Shortages, mis-shipments and mis-billings must be reported to MegaDropShippers Customer Support within 3 days of delivery date/expected delivery date. Original boxes, enclosed documentation and packing materials should be saved.
2. Mis-shipments (incorrect product shipments) are credited in full (plus original shipping and handling charges) once the product is returned to Megadropshippers. Any incorrect product shipments will be temporarily invoiced for inventory purposes until the item is returned and credited. This credit will offset the invoice amount. Megadropshippers will issue a UPS call tag for pick of the items at the customers address. Items must be returned in an unused and unopened state for full store credit to be issued.
3. Replacement product must be ordered again as a new order with a new order number. Shipping and handling charges will apply on the new order.
4. If orders are duplicated or excess merchandise is shipped, you must contact MegaDropShippers Customer Support and request an RMA#. Your customer should then be contacted and the second order should be refused or the excess merchandise returned, before credit will be given.
5. If it is proven that MegaDropShippers has made the error, a Returns Authorization Tag may be sent for your customer to return the product freight free. When the merchandise is returned in an unused and unopened state, full credit will be given. Your help in contacting your customer to return product shipped in error helps to keep MegaDropShippers prices low and competitive.
6. If you place a shipment that is flagged by our system as an incorrect/invalid address the order will be cancelled and you will receive store credit so you may reorder at your convenience with the corrected address. This policy will also pertains to orders were the incorrect shipping method is used (Example using UPS Ground service to ship to a P.O. Box).
Shipping Insurance Policy as of 09/19/07
USPS Insurance
1. UPS shipments-
A.Megadropshippers default insurance:
Megadropshippers will automatically insure your entire order for up to $100 in the event that the package is verifed lost or damaged by UPS. The dropshipper has the option to purchase additional insurance for their purchase via the respective product page of the product. In the event that items in your order have been verified damaged or lost by UPS and you have not purchased additional insurance for your order, then you will receive store credit for your purchase of up to $100 only. If the amount of your original purchase was less than $100, then you will receive store credit at that exact amount only. Lost or damaged shipments must be reported to Megadropshippers within 7 business days of shown receipt date at www.ups.com (via UPS tracking number). All lost or damaged shipment inquiries must be sent to sales@megadropshippers.com. We do not accept lost or damaged shipment inquiries via telephone, live chat, or by leaving a message via live chat when live chat is offline. We will need a customer contact phone number of the recipient to file an insurance claim and/or tracer with UPS. Please provide this information in your email to sales@megadropshippers.com. UPS insurance claim and tracer filings take 1-8 business for a resolution to be reached from date of filing. Store credit will be issued to the dropshipper once Megadropshippers is notified by UPS and the outcome of UPS's investigation states that the merchandise was damaged in transit or lost.
B.Additional insurance purchased by the dropshipper/buyer:
The dropshipper has the option to purchase additional insurance for their purchase via the respective product page of the product. In the event of lost or damaged merchandise by UPS, your order will be insured by UPS for the amount of insurance that you have purchased for your order plus the Megadropshippers default insurance amount of $100. All lost or damaged shipment inquiries must be sent to sales@megadropshippers.com. We do not accept lost or damaged shipment inquiries via telephone, live chat, or by leaving a message via live chat when live chat is offline. We will need a customer contact phone number of the recipient to file an insurance claim and/or tracer with UPS. Please provide this information in your email to sales@megadropshippers.com. UPS insurance claim and tracer filings take 1-8 business for a resolution to be reached from date of filing. Store credit will be issued to the dropshipper once Megadropshippers is notified by UPS and the outcome of UPS's investigation states that the merchandise was damaged in transit or lost.
2. USPS Insurance
A. Megadropshippers default insurance:
There will be no Megadropshippers default insurance offered for packages shipped via USPS. The dropshipper has the option to purchase insurance for their purchase via the respective product page of the product. In the event that items in your order have been verified damaged or lost by USPS and you have not purchased insurance for your order, then you will not receive store credit for your purchase from Megadropshippers. We strongly encourage all dropshippers to purchase insurance for their orders that are being shipped via USPS.
B. Insurance purchased by the dropshipper/buyer: The dropshipper has the option to purchase insurance for their purchase via the respective product page of the product. In the event of lost or damaged merchandise by USPS, your order will be insured by USPS for the amount of insurance that you have purchased for your order. Per www.usps.com: Claims for Loss – can be filed 21 days (after mailing) at the earliest, and no more than 180 days after mailing. Claims for Damage or Partial Loss – may be filed immediately, and no more than 60 days after mailing. In the case of damaged merchandise, a digital photo of the damaged merchandise may eed to be supplied to us for USPS's purposes. All lost or damaged shipment inquiries must be sent to sales@megadropshippers.com. We do not accept lost or damaged shipment inquiries via telephone, live chat, or by leaving a message via live chat when live chat is offline. We will need a customer contact phone number of the recipient to file an insurance claim and/or tracer with USPS. Please provide this information in your email to sales@megadropshippers.com. USPS insurance claim and tracer filings take 1-10 business for a resolution to be reached from date of filing. Store credit will be issued to the dropshipper once Megadropshippers is notified by USPS and the outcome of USPS's investigation states that the merchandise was damaged in transit or lost.

Warranty Disclaimer
This site and the materials and products on this site are provided "as is" and without warranties of any kind, whether express or implied.
